1. Website use

You may use this website only for lawful purposes and in a way that does not interfere with the security, performance, availability, or proper operation of the website. You agree not to attempt unauthorized access, submit malicious code, scrape the site in a harmful way, overload the site, impersonate another person, or use the site for spam, fraud, harassment, infringement, or other unlawful activity.

2. Inquiries, estimates, and booking

Submitting an inquiry, form, message, requested date, budget, or project idea does not create a confirmed booking, client relationship, exclusive hold, or service agreement. A project is confirmed only when Weissprod accepts the project in writing and any required agreement, deposit, retainer, invoice, or scheduling step is completed. Availability, pricing, scope, timelines, deliverables, revisions, usage rights, cancellations, travel, and payment terms may be stated in a separate proposal, invoice, contract, or written agreement.

3. Client responsibilities

You are responsible for providing accurate information, obtaining needed permissions, securing locations, following venue rules, identifying deadlines, reviewing proofs or drafts on time, and making sure any materials you provide may lawfully be used. You are responsible for the accuracy, legality, and ownership of logos, music, images, trademarks, copy, artwork, footage, references, or other materials you upload, send, or request to be included in a project.

4. Payments, retainers, cancellations, and rescheduling

Payment terms are controlled by the applicable invoice, proposal, written agreement, or checkout process. Unless a separate written agreement says otherwise, deposits, retainers, rush fees, travel fees, production costs, and completed work may be non-refundable because they reserve time, cover preparation, or compensate work already performed. Missed appointments, late approvals, weather issues, venue restrictions, client delays, or changed scope may require additional fees or revised timelines.

5. Revisions and deliverables

Deliverables, formats, file types, image counts, edit counts, usage rights, turnaround times, revision rounds, and archive periods must be agreed to in writing. Unless a separate agreement says otherwise, Weissprod may use professional creative judgment in selection, editing, color, sequencing, crop, audio, pacing, design, and final presentation. Raw files, working files, project files, unused images, unedited footage, design source files, or behind-the-scenes production materials are not included unless expressly agreed to in writing.

6. Intellectual property and copyright

All website text, layouts, graphics, images, videos, logos, designs, code, concepts, and other content on this website are owned by Weissprod, its licensors, or the credited rights holders and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, download, modify, distribute, sell, publish, or create derivative works from website content without written permission, except for ordinary personal viewing or sharing a public website link.

Rights in client deliverables are controlled by the applicable written agreement. Unless a written agreement says otherwise, Weissprod retains copyright and ownership of original creative work, and the client receives only the usage license expressly granted for the paid project. Unauthorized editing, resale, relicensing, commercial use, AI training, removal of credits/watermarks, or use outside the agreed scope may be prohibited.

7. Portfolio and promotional use

Unless a written agreement says otherwise, Weissprod may display lawfully created work, behind-the-scenes content, project excerpts, testimonials, business names, and non-confidential project details in portfolios, social media, websites, reels, case studies, marketing materials, awards submissions, and similar promotional uses. Confidentiality, embargoes, private delivery, brand restrictions, or special approval requirements must be agreed to in writing before the project is booked.

8. No guarantees

The website and its content are provided for general informational and promotional purposes. Weissprod does not guarantee that the website will be uninterrupted, error-free, secure, current, or compatible with every device, browser, plugin, or third-party service. Website examples, portfolio pieces, estimated timelines, pricing references, and service descriptions are not guarantees of identical results for every project.

9. Third-party links, platforms, and tools

The website may connect to third-party websites, platforms, booking tools, payment processors, analytics providers, galleries, social networks, video players, maps, plugins, or embedded content. Third-party services are governed by their own terms and policies. Weissprod is not responsible for third-party content, availability, security, billing, privacy practices, or service failures.

10. User-submitted materials

By submitting materials through the website or for a project, you represent that you have the right to provide and authorize use of those materials. You grant Weissprod permission to access, review, store, process, edit, display, and use submitted materials as reasonably needed to respond to your inquiry, evaluate the project, provide requested services, create deliverables, protect the business, or comply with legal obligations.

11. Limitation of liability

To the fullest extent allowed by law, Weissprod and its owners, contractors, collaborators, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, lost-profit, lost-revenue, lost-data, reputational, business-interruption, or similar damages arising from use of the website, inability to use the website, third-party services, submitted materials, or website content. To the fullest extent allowed by law, any direct liability connected to website use is limited to the amount you paid directly to Weissprod for the specific website-related service giving rise to the claim, or one hundred dollars if no such amount was paid.

12. Indemnification

You agree to defend, indemnify, and hold harmless Weissprod and its owners, contractors, collaborators, and service providers from claims, damages, liabilities, losses, costs, and expenses arising out of your misuse of the website, violation of these terms, infringement of another person’s rights, unlawful conduct, or materials you submit or ask Weissprod to use.

13. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute relating to the website or these terms must be brought in a court with proper jurisdiction in Texas, unless applicable law requires a different venue.

14. Changes to these terms

Weissprod may update these Terms of Service at any time by posting a revised version on this page. The updated terms apply to website use after the revised terms are posted. Separate written project agreements, if any, control over conflicting website terms for that specific project.
